Mike Wilson, the Republican candidate for a still-contested state house seat, wants the provisional ballots in the three Lincoln Heights precincts to receive special scrutiny before they're counted because he believes them to be "suspect."
The lawsuit was filed Monday in Hamilton County Common Pleas Court by attorney Christopher R. McDowell on behalf of Wilson and Cook.
Provisional ballots are cast when election poll workers cannot determine whether a voter is entitled to cast a valid ballot. Often, provisional voters are people who changed their address or name after the voter registration deadline.
In the Nov. 2 election, incumbent Democrat Connie Pillich received five more votes than Wilson in the race for 28th House District, which covers northern and northeastern Hamilton County. The provisional ballots could determine the winner of the race.
The lawsuit says the number of provisional ballots is disproportionately high in the three Lincoln Heights districts and that the number of Lincoln Heights voters in the race seems higher than it should be for a village with a shrinking population.
Of the 1,456 provisional ballots cast in Ohio 28 House District race, 136 or 9 percent, were from Lincoln Heights Precincts A, B and C. The 984 Lincoln Heights votes cast in the race was only 2.3 percent of the race's total number of votes.
This issue will be presented before Hamilton County Common Pleas Judge Robert Winkler at 9 a.m. Tuesday. The Hamilton County Board of Elections has scheduled a meeting 11:30 a.m., Tuesday to review the provisional ballots and the remaining absentee ballots. But Tim Burke, an elections board member and chairman of the Hamilton County Democratic Party, said the board will have to wait to see what Winkler rules.
"We'll comply with whatever he orders," he said.
Pillich said the lawsuit's arguments for taking special steps to screen Lincoln Heights provisional ballots seem weak. She said it's not valid to compare the number of provisional ballots in Lincoln Heights with those in the rest of the district.
"There is an unusually high number of poor people in Lincoln Heights," Pillich said. "There's been a lot of rebuilding there and a lot of address changes. Most of the other communities in my district are better off financially than Lincoln Heights. It's like comparing apples and oranges."
The board of elections will count the ballots on Nov. 22 and will approve them on Nov. 23. If the vote totals for Pillich and for Wilson are close enough, there will be a recount of all ballots cast in the race.

Let's Play Two!

Enjoyed the double-header where first Connie Pillich, then Steve Driehaus, drowned their opponents with accomplishments and relevant facts in faux debate, and artfully dodged the misty raindrops in return. Both of "our guys" were fullsome with pungency and zingers. If raw ability were the determinant they both would win big November 2nd. Connie and Steve, I mean.
Both had prepared, and had been prepared, finely. Steve was jaw-droppingly Kennedyesque, showing, in my opinion, world-class improvement from his prior then-best excellent level of presentation (at the Iron Horse, for example). He, at 44, outed an aged-looking -- HD hurt Chabot -- opponent, who was only 57.
Connie at Princeton High School Matthews Auditorium at 7 pm, and Steve on Channel 9 at 8 pm. I TIVO'd the latter and the former will be available on local cable ICRC.
Connie smoothly demonstrated she was the most effective representative one could be and her opponent pompously said he stood on his "status" of being an IP know-nothing -- proudly not being a politician and proudly not being a lawyer: then demonstrated that he was an up and coming pain in the butt a la Boehner. He flippantly and ham-handedly referred to the 3 C's Rail Plan as "The Crazy Train."
With the false advantage of being free to attack anything or anyone who had actually done anything in the past for Ohio voters and communities, Republican or Democrat, Connie's opponent promised to go to Columbus and lay waste everything of merit east of the Olentangy, and to report the promised chaos (e.g. no more state income tax) back via the internet.

“We see the proof of this [Ohio's inhospitality to corporations] in the news when venerable Ohio companies like NCR (founded in Dayton in 1884)… leave for other states and take their jobs with them. We didn’t lose these jobs to overseas competition. We lost them to Georgia and Kentucky. …”
He said "Governor Strickland offered NCR tax breaks totaling $31.1 million in an effort to keep them in Ohio. While that unfortunately wasn’t enough, what it shows is a recognition that the tax climate in Ohio matters and it is so out of whack that a $30 million incentive is insufficient to keep a company here.”
Of course being such a know-nothing, he was unaware that it was 2007 (pre-Pillich) when the Executive Offices were moved to New York City and he was unaware that the vast middle-class blue-collar jobs at NCR were gone decades ago (pre Strickland); thus he did not know how many – relatively small number-- jobs were lost when NCR finally pulled out its Dayton headquarters recently (1,300 white collar, according to the Dayton Daily News; cf. with 18,000 plus jobs at full tilt, per same story)

"Do you thus advocate throwing untolled taxpayers’ money at corporations whose laborers have already left, in order to outbid other states for their mere 'headquarters?'” the audience thought.
Both debates were noteworthy as evidence that the Limbaugh use of the term "liberal" as a perjorative word, was dead. It was not mentioned in the 7 pm debate. To his credit Wilson eschewed the Limbaugh trope and it was used by Chabot only once, 18 minutes in.

Connie Pillich in Today's Enquirer
A thumbnail of both candidates. Her opponent is beholden to Fox News (see earlier blog today). He is such an unknown and no-show (to meaningful debate i.e. last week) that there are 180 people with his exact first and last name in the Cincinnati area, and he could be any one of them.
Zero experience. Works for an unknown out-of-town company. Is promising to go to Columbus with the purpose of solving an $8 billion deficit without raising taxes.
So we should be sending a person who doesn't believe in government, to be our representative in government. This is the thinking that so denuded the SEC during the Bush Administration that its litigators were so starved for resources that they regularly had to go down the street, wait in line and get copies at Kinko's in litigation against the big law firms!
In the same Enquirer "article" today is a thumbnail sketch of same Connie's opponent. In his sketch he claims to provide his direct cell phone number which I have not tried. Ever called a Bot before?
He did appear at last month's Glendale Village Council Meeting and also the Glendale Street Fair, but said only three sentences at the former. He appeared to resemble 180 people I have met before, with an oval face and standard features.

Remember how -- still -- the name-calling of our side as "Liberal" was scrotum-withering? Well, let's do the same. Call the opponent a name: "Republican" and leave it at that.
After the Bush years and last two years in Congress, winning an election for any Democrat against the talk-show Republicans -- and all Republicans perforce, must bow to, the talk-show Republicans -- should be as easy as winning a Christian-Democrat -- National Socialist election just after the devastation of WWII.
On the podium (Driehaus, say, or Strickland, or Pillich, with a raised eyebrow and a touch of sarcasm):
"Hey," "This guy, my opponent, is a Republican."
"Case closed."
This was the approach of William F. Buckley Jr. Toward the end of his life he admitted that the key to his successful arguments was not the content he put out, but the one-phrase repost, the raised eyebrow. Let the voters imagine the horrors of the eight years leading up to 2008, when Obama was voted in. Treat the voters like adults. They have lived through those eight years. They know.
P.S. My daughter, upon reading this, points out that "they don't know." If that is true, turn to the Memory Hole argument. Or I have another analogy: the U.S. economy now has pneumonia because the Republicans had it standing coatless in the winter cold for eight years, and even longer in reality, due to intimidating the Clintons, and the Reagan years. Do we dare stand out in another winter coatless?
